Hateful Speech in Delhi Revolts

Published

on

The High Court on Monday sought a response from several political leaders, including Congress interim president Sonia Gandhi, her son Rahul Gandhi, daughter Priyanka Gandhi Vadra, Delhi Chief Minister Arvind Kejriwal, and Deputy Chief Minister Manish Sisodia, over a plea to implead them as parties to proceedings seeking an FIR and investigation for allegedly delivering hate speeches that led to the Delhi Riots.

The division bench of the High Court, headed out by Justices Siddharth Mridul & Anoop Kumar Mendiratta, gave notice to all potential respondents and requested their responses on the impleadment motion, and the matter has now been set for hearing on March 22.

The Supreme Court said, “We are on the clock.”

The court was considering a slew of petitions demanding a variety of things, including an independent investigation by a Special Investigation Team (SIT) into the violence that erupted in the national capital in February 2020. Two impleadment applications have been filed in the batch of petitions: one by petitioner Shaikh Mujtaba Farooq, who is seeking a hate speech FIR against BJP leaders Anurag Thakur, Kapil Mishra, Parvesh Verma, and Abhay Verma, and the other by Lawyers Voice, who is seeking hate speech FIRs against Congress leaders Sonia Gandhi, Rahul Gandhi, and Priyanka Gandhi Vadra, as well as

On a previous date, the court allowed petitioners’ attorneys time to file petitions to add specific political figures as parties to the pleas alleging that they provided hate statements that contributed to the 2020 violence. Other reliefs sought in the batch of petitions were the establishment of an SIT, the filing of FIRs against police officials who were allegedly involved in the violence, and the disclosure of those arrested and detained.

In response to the petitions, the Delhi Police announced that three Special Investigation Teams (SITs) under the Crime Branch had been established to investigate the crimes related to the Delhi riots. The municipal police department also said that no proof of police participation has been discovered yet.

The petitions, which were previously handled by a bench consisting of Chief Justice D N Patel and Jyoti Singh, have now been shifted to a bench consisting of Justices Siddharth Mridul and Anoop Kumar Mendiratta by an administrative decision dated January 28. The high court noted that the Supreme Court had asked it to dispose of a plea seeking the registration of an FIR against some politicians for their alleged hate speeches that allegedly led to the riots in north-east Delhi last year promptly, preferably within three months, in an order issued on December 17, 2021.

“We’re working with a clock. Their (the Supreme Court’s) desires are orders for us to follow. The goal is to resolve the situation quickly “When Additional Solicitor General Aman Lekhi stated the supreme court had not placed the high court on the clock, Justice Mridul answered.
