Justice Chandrachud has said no to the deployment of central soldiers in West Bengal s local elections

Given the large recent violence in West Bengal during previous local body elections, the Supreme Court denied a petition filed by Bhartiya Janata Party (BJP) leaders Mousumi Roy and Pratap Banerjee demanding the deployment of central forces in the West Bengal local elections on Friday.

According to sources, a Supreme Court bench comprising of Justice DY Chandrachud and Justice Surya Kant denied the BJP leaders’ special leave plea challenging the Calcutta High Court’s ruling.

The Calcutta High Court has previously refused to approve orders for the deployment of central forces for the upcoming elections to West Bengal’s 108 municipalities, which are slated for February 27.

Several BJP leaders sued in the High Court alleging widespread violence and vote manipulation during West Bengal’s recent municipal elections. They wanted to use central troops to win the remaining 108 municipalities in the next elections.

The State Election Commission (SEC) was ordered by a division bench of the Calcutta High Court to assess the ground situation by gathering information about the conditions in the municipalities and consulting the Home Secretary, Director-General, and Inspector General before deciding on the deployment of central paramilitaries.

If it is decided that central forces will not be deployed in the state, the State Election Commissioner will be held personally responsible for ensuring that there is no violence, according to the High Court.

Senior Advocate PS Patwalia, who was representing the petitioner before the Supreme Court bench on Friday, contended that there had been widespread complaints of violence during the preceding phases of the elections. He claimed the State Election Commission was biased in favor of the ruling All India Trinamool Congress.

“The SEC relies on the official newspaper of the Trinamool Congress, “Joy Bangla.” Patwalia testified before the Supreme Court, “We had placed on record the reports of The Hindu, the New India Express, and other newspapers concerning the violence.”

The Supreme Court, on the other hand, dismissed the appeal, stating that no central forces will be deployed during the West Bengal municipal elections.

“Your Lordships have chosen not to entertain this,” said Solicitor General Tushar Mehta. However, in the case of the Tripura elections, the Court had inquired if the government might intervene. I believe we will have no difficulty in deploying the forces.”

“Thank you, Mr. Solicitor,” Justice Chandrachud said as he dismissed the arguments.

In recent years, the TMC has perpetrated extensive political violence in West Bengal. Hundreds of BJP activists and leaders have been killed, and thousands more have been assaulted by TMC supporters. Following TMC’s victory in the assembly elections, the violence escalated, forcing hundreds of people to flee to neighbouring states.

The Anti-Human Trafficking Unit (AHTU) of Navi Mumbai Police arrested Jeorge Ocante DaSilva, a 35-year-old native of Guinea, on Monday for possessing 410 grams of cocaine, allegedly intended for illegal sale. Acting on a tip-off, API Alka Patil of the AHTU led a raid at RM Heights Building in Ulwe, where DaSilva was found in possession of the narcotics.

Around 2:30 p.m. on October 28, officers discovered 410 grams of cocaine, valued at approximately Rs 1,02,50,000, hidden in DaSilva’s bedroom. Authorities also seized a mobile phone, a black Tabata weighing scale, scissors, plastic packaging bags, and a sky bag, bringing the total seizure value to Rs 1,02,55,610.

An FIR was filed at Panvel City Police Station under Sections 8(a) and 21(a) of the Narcotic Drugs and Psychotropic Substances (NDPS) Act. Dasilva was presented in court and remanded to police custody until October 31, 2024. Investigations are ongoing, with the Crime Branch seeking potential accomplices and sources of the narcotics. Notably, Dasilva has a prior NDPS case registered at Nahar Police Station in Mumbai.
