The Karnataka High court rejected all writ petitions of Muslim learners

The Karnataka High Court handed down its decision in the hijab petition brought up by Muslim female students. According to the court’s order, the hijab is not an important practice of the Islamic faith, hence all petitions filed by Muslim female students seeking authorization to wear the hijab in educational institutions have been denied.

The Chief Justice of the Karnataka High Court handed down the decision. The court noted that they developed a few questions and answered them to decide the case after taking a holistic picture of the situation. The issues were whether wearing a headscarf is an essential religious practice in the Islamic religion that is protected under Article 25 and if requiring students to wear a school uniform is a violation of their rights. Apart from being incompetent and arbitrary, the court also wanted to know if the Government Order of February 5 violated Articles 14 and 15.

The court decided that wearing a hijab is not an important religious practice of Islam and that requiring a uniform is a legitimate restriction on fundamental rights. The court went on to say in the judgment that there is no reason to invalidate the February 5 Government Order.

The court’s detailed decision is pending.

Hijab row in Karnataka

Several Muslim students at Pre University College of Karnataka asked the High Court to be permitted to take classes while in the hijab. According to the college administration, they were denied access to classes since the hijab isn’t part of the college uniform and so can’t be worn in class. Since then, the students have started holding demonstrations in burqas.

In December 2021, Muslim students began wearing hijab and burqa to school and college in violation of uniform standards after meeting with the Campus Front of India (CFI), the student section of the Islamist organization Popular Front of India (PFI). The pupils admitted to conversing with the CFI.

The Anti-Human Trafficking Unit (AHTU) of Navi Mumbai Police arrested Jeorge Ocante DaSilva, a 35-year-old native of Guinea, on Monday for possessing 410 grams of cocaine, allegedly intended for illegal sale. Acting on a tip-off, API Alka Patil of the AHTU led a raid at RM Heights Building in Ulwe, where DaSilva was found in possession of the narcotics.

Around 2:30 p.m. on October 28, officers discovered 410 grams of cocaine, valued at approximately Rs 1,02,50,000, hidden in DaSilva’s bedroom. Authorities also seized a mobile phone, a black Tabata weighing scale, scissors, plastic packaging bags, and a sky bag, bringing the total seizure value to Rs 1,02,55,610.

An FIR was filed at Panvel City Police Station under Sections 8(a) and 21(a) of the Narcotic Drugs and Psychotropic Substances (NDPS) Act. Dasilva was presented in court and remanded to police custody until October 31, 2024. Investigations are ongoing, with the Crime Branch seeking potential accomplices and sources of the narcotics. Notably, Dasilva has a prior NDPS case registered at Nahar Police Station in Mumbai.
