Student in Ukraine has filed a case with the Supreme Court in India

Fathima Ahana Muhammed Ashraf, an MBBS student at National Medical University in Odessa, Ukraine, filed a writ case in the Supreme Court today, demanding justice for herself and other individuals trapped in Ukraine due to the ongoing conflicts between Russia and Ukraine.

The appeal asked the Indian government to seek permission for the Petitioner and other stranded Ukrainian students to pass via Moldova on their way to Romania to board an Air India evacuation flight.

Fathima Ahana Mohamed Ashraf, along with 250 other medical students, was stuck at the Moldova-Ukraine border, according to Senior Advocate AM Dar, Adv Danish Majid Dar, and Advocate Abhay Anand Jena.

Attorney General KK Venugopal, representing the Indian government, indicated in court today that the petitioner, along with 250 other stranded students, had crossed into Romania and would be flown back to India on a special flight.

The Attorney General stated in court that he had communicated the Court’s views to PK Mishra IAS, the Secretary to the Prime Minister’s Office, who subsequently passed them on to Union Minister Jyotiraditya Scindia, who is currently in Romania overseeing the rescue attempts.

“She’s been reached, and they’ll be flying today.” Mr. Mishra provided this information. The AG told the bench that Fathima Ahana and her companions should be in India by tonight.

Lawyer Vishal Tiwari has also filed a Public Interest Litigation (PIL) seeking directions for the safety of students and families trapped in Ukraine as a result of the current crisis.

During the hearing, the CJI chastised Advocate Vishal Tiwari for threatening to launch a Public Interest Litigation in the case and questioned whether he was seeking publicity by exploiting the situation. The CJI reminded him that he had noticed on the Supreme Court website that Tiwari had filed a number of PILs that had been dismissed with penalties.

“This is not the method to file petitions using paper cuttings and other such materials if you want to do something.” You know this is a delicate issue; we can’t say anything, so don’t try to take advantage,” Tiwari was admonished by the Chief Justice of India.

The Court also ordered Attorney General Venugopal to use his power to help Indian students who have been stranded in Ukraine as a result of Russia’s invasion. The government, like the Court, is concerned, according to the Attorney General. Next Friday, the Court will hear the matter.
