Bombay High Court Slams Maharashtra Govt Over Illegal Constructions in Navi Mumbai

The Bombay High Court has sharply criticised the Maharashtra government for failing to curb the alarming rise of illegal constructions in Navi Mumbai, observing that the administration “cannot remain a mute spectator” while unauthorised buildings continue to mushroom across the city. Hearing a petition concerning large-scale violations, the court noted that more than 2,100 buildings in Navi Mumbai are either constructed without mandatory approvals or have flouted sanctioned development plans. The bench remarked that such widespread irregularities point to a “systemic failure” and hinted at a possible nexus between errant developers and corrupt officials, stressing that accountability must be fixed.

Directing the state’s Urban Development Department to formulate a comprehensive policy to tackle illegal construction across Maharashtra, the court said a piecemeal approach would not work given the scale of violations. It also instructed the Navi Mumbai Municipal Corporation (NMMC) to conduct a detailed survey within four months to identify all unauthorised or irregular structures within its jurisdiction and initiate appropriate action.

While dismissing the petition before it, the court clarified that the order should not be interpreted as a clean chit to any illegal activities, adding that “ongoing violations cannot be legitimised” merely because a case is closed. The court emphasized that the state must proactively enforce development regulations and ensure transparent functioning within planning authorities to prevent further damage to civic infrastructure and public safety.

Raising a stern alarm over reckless urban expansion, State Minister Ganesh Naik has ordered a crackdown on questionable redevelopment projects across Navi Mumbai, taking a strong stand to protect the planned character of the satellite city.

Focusing on two controversial redevelopment sites in Vashi Sector 9 the Naivedya and Albela buildings Naik directed municipal officials to immediately halt suspicious demolitions, revoke dubious commencement certificates (CCs), and initiate strict action against civic personnel involved in illegal approvals.

Addressing citizens at a recently held Janata Darbar, Naik voiced deep concern over the misuse of cluster redevelopment schemes and Floor Space Index (FSI) regulations, warning that unchecked high-rise construction without matching infrastructure will overwhelm roads, water supply, and parking facilities.

“If increased FSI is granted to every building without planning proper roads, parking, and water supply, Navi Mumbai will become completely unliveable,” Naik asserted, urging an immediate audit of civic approvals. Ganesh Naik’s firm stance underlines a growing effort to hold civic authorities accountable and ensure that urban renewal respects public safety, transparency, and the long-term wellbeing of residents.
