In A Case Involving Housing Fraud In Navi Mumbai, The Bombay High Court Grants Bail To The Builder
Builder Gopal Amarlal Thakur of the Monarch Universal Group, who was detained by the Directorate of Enforcement (ED) in relation to a housing fraud case in Navi Mumbai, has been granted bail by the Bombay High Court.
Because of Thakur’s “long incarceration with remote possibility of the trial being completed within a reasonable period of time,” Justice Manish Pitale granted Thakur bail. After being taken into custody on July 1, 2021, Thakur was detained for three years, one month, and seven days before being released on bail on August 8.
Rajiv Chavan, Thakur’s lawyer, stated that his client is accused of predicate offenses and has been granted bail in each of those instances. It would take a long time for the trial to end in the ED case because charges have not yet been filed and the record indicates that the prosecution plans to question 67 witnesses.
If Thakur is found guilty, the maximum sentence that might be given is seven years in jail. Thus, according to Chavan, he has served almost half of the maximum sentence in jail.
Sandesh Patil, the Special Public Prosecutor, objected to the bail request, arguing that it would not be appropriate to overlook the predicament of those who have reserved apartments in the projects that the applicant and the other defendants are associated with.
Patil said that after a settlement, the FIR for one of the predicate crimes was dismissed; nonetheless, Thakur and the other defendants disregarded the terms of their assent. Thus, the offense is committed again. Accordingly, Patil continued, the applicant’s behavior should be taken into account.
The court pointed out that a defendant may only get a maximum term of seven years under the Prevention of Money Laundering Act. Judge Pitale granted Thakur bail after he provided a personal bond of Rs 50,000, stating, “These facts clearly demonstrate that Thakur having undergone incarceration for a period of three years, one month and seven days is entitled to be released purely on the ground of long incarceration with remote possibility of the trial being completed within a reasonable period of time.”
The Enforcement Department (ED) claims that Thakur skimmed off and transferred large sums of money obtained from investors to its several sibling organizations. Significant Proceeds of Crime (PoC) were parked with many Navi Mumbai builders, including Baba Homes Builders and Developers, Lakhani Builders Private Limited, Monarch Solitaire LLP, and others, through a convoluted web of money trails. A probe found that the directors of Monarch Group had marketed the identical apartments to many purchasers. Without the consumers’ knowledge, they mortgaged the apartments that had previously been sold to get loans from the NBFC.
