For sending obscenes messages to Belapur MLA Manda Mhatre a Jalgaon activist was accused.

The Messages

Deepak Kumar Gupta, an RTI activist and social worker from Jalgaon, had been acquitted in the Belapur court of sending obscene messages and threats to Manda Mhatre, a member of the Belapur Legislative Assembly. Deepak Gupta was taken into custody by the police as a result of the 2017 claims.

The case took an unexpected turn with Gupta’s recent acquittal. It drew notice when five Maharashtra MLAs, including BJP MLA Manda Mhatre, Legislative Council Deputy Speaker Neelam Gorhe, MLAs Vidya Chavan, Deepika Chavan, and Anil Gote, filed charges against Gupta. The prosecution said that Gupta used forged documents in his name and a fake SIM card from Bhusawal to send threatening texts. The inquiry showed that the SIM card was obtained by a person posing as Gupta and asserting that he was disabled. Cross-examination of six witnesses took place throughout the hearings.

Even though MLA Manda Mhatre received the offensive texts from his cell phone, Gupta was found innocent due to the absence of substantial evidence and MLA Manda Mhatre’s withdrawal of the complaint. The texts were unreachable because, according to MLA Manda Mhatre, he was no longer using the concerned cell phone.

Deepak Kumar Gupta, who is well-known for talking up against purported administrative wrongs involving important political figures in Jalgaon, may have been wrongly accused, according to the defence. Gupta has made accusations against the police himself, saying that the Superintendent of Police in Dhule at the time had arrested him in Jalgaon before the complaint was formally filed.

This acquittal reveals a pattern of legal barriers experienced by Gupta in several jurisdictions, as seen by similar outcomes in lawsuits brought by MLAs Vidya Chavan, Deepali Chavan, Anil Gote, and Neelam Gorhe. Questions regarding the circumstances underlying the charges and the extent of Gupta’s advocacy against the Jalgaon political elite persist as the judicial struggle draws to a close.
